TERMS & CONDITIONS

1. INTRODUCTION

These Terms & Conditions ("Terms") govern your use of services provided by Averde Estate ("we," "us," "our," or "Averde"), a luxury seafront event venue and boutique hotel located at 12 Athinon St., 7081, Pyla, Larnaca, Cyprus. By making a booking or using our services, you ("you," "your," or "Client") agree to be bound by these Terms.

2. SERVICES PROVIDED

Averde Estate offers:

  • Luxury event hosting (weddings, christenings, corporate events, private parties)
  • Boutique hotel accommodation (10 rooms and suites)
  • Event planning and coordination
  • Photography and videography coordination
  • Transportation and concierge services

3. BOOKING AND RESERVATIONS

3.1 Event Bookings

  • All event bookings require a signed contract and deposit payment
  • We operate a "one event per day" exclusive policy
  • Event dates are confirmed only upon receipt of deposit and signed agreement
  • Minimum booking periods may apply for different event types
  • Guest capacity limits apply based on venue space and local regulations

3.2 Accommodation Bookings

  • Room reservations are confirmed upon receipt of deposit
  • Check-in time: 3:00 PM / Check-out time: 11:00 AM
  • Valid identification required for all guests (passport or EU ID card)
  • Maximum occupancy limits strictly enforced for safety compliance

3.3 Booking Modifications

  • Changes to confirmed bookings subject to availability and additional charges
  • Date changes may incur rebooking fees
  • Guest count increases may incur additional charges
  • Menu or service modifications must be confirmed in writing
  • Changes requested within 30 days of event may incur penalty charges

4. PAYMENT TERMS

4.1 Event Bookings

  • Non-refundable deposit: 50% deposit must be paid in order to confirm the venue
  • Final payment: The remaining 50% and refundable damage deposit will be paid 5 days before the event
  • Additional charges (extras, damages) due within 7 days of invoice

4.2 Accommodation Bookings

  • Deposit: 50% deposit must be paid upon booking
  • Balance payment: The remaining 50% due 5 days before the event
  • Incidental charges: Settled upon departure
  • City tax (if applicable): Paid directly at property

4.3 Payment Methods

We accept:

  • Cash payments
  • Bank transfers

4.4 Currency

  • All prices quoted in Euros (EUR)
  • Exchange rate fluctuations may affect final pricing for foreign currency payments

5. CANCELLATION AND REFUND POLICY

5.1 Event Cancellations by Client

  • More than 365 days before event: 70% refund of deposits paid
  • 365-180 days before event: 50% refund of deposits paid
  • 179-90 days before event: 25% refund of deposits paid
  • 89-30 days before event: 10% refund of deposits paid
  • Less than 30 days before event: No refund

5.2 Accommodation Cancellations by Client

  • 14 days prior to arrival: Free cancellation
  • 7 days before arrival: 50% cancellation fee
  • Less than 7 days before arrival: No refund
  • No-show: Full charges apply

5.3 Cancellations by Averde Estate

  • Full refund of all payments if we cancel your booking
  • Alternative dates or venues offered when possible
  • Compensation limited to amounts paid to Averde Estate
  • No liability for consequential losses or third-party costs

6. FORCE MAJEURE

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including:

  • Natural disasters, extreme weather conditions
  • Government regulations, travel restrictions
  • Public health emergencies, pandemic restrictions
  • War, terrorism, civil unrest
  • Strikes, labor disputes
  • Utility failures, infrastructure damage

In such circumstances, both parties will work toward mutually acceptable solutions, which may include postponement or partial refunds.

7. GUEST CONDUCT AND PROPERTY RULES

7.1 General Conduct

  • All guests must comply with Cyprus laws and local regulations
  • Respectful behavior toward staff, other guests, and property required
  • Noise restrictions apply, especially during late evening hours
  • Smoking permitted only in designated outdoor areas
  • No illegal substances or activities permitted on premises

7.2 Event Conduct

  • Music and entertainment must end by times specified in local permits
  • Decorations and signage require prior approval
  • External vendors must be approved
  • Security deposit may be required for large events
  • Damage to property will be charged to the client

7.3 Accommodation Rules

  • Maximum occupancy limits strictly enforced
  • No pets allowed unless pre-arranged (service animals excepted)
  • Lost key cards incur replacement charges
  • Early departure does not reduce accommodation charges

8. LIABILITY AND INSURANCE

8.1 Limitation of Liability

  • Our liability is limited to the total amount paid for services
  • We are not liable for indirect, consequential, or special damages
  • We are not liable for personal property loss or damage
  • We are not liable for third-party service provider failures
  • Force majeure events exclude all liability

8.2 Client Responsibilities

  • Clients liable for guest behavior and property damage
  • Clients responsible for compliance with all applicable laws
  • Clients must provide accurate guest counts and requirements
  • Clients liable for any legal violations by guests or vendors

8.3 Property Insurance

  • Averde Estate maintains comprehensive property and liability insurance
  • Insurance does not cover client personal property or vendor equipment
  • Clients advised to maintain travel and event insurance
  • Insurance claims must be reported within 24 hours

9. HEALTH AND SAFETY

9.1 Covid-19 and Health Protocols

  • Current health and safety protocols available upon request
  • Clients responsible for compliance with applicable health measures
  • Event capacity may be limited by current government regulations

9.2 Food Safety and Allergies

Menu modifications for dietary restrictions are the responsibility of the catering company providing the service. We do not accept responsibility for the preparation or handling of food. Clients must liaise directly with the catering provider to ensure their dietary needs are met.

9.3 Safety and Security

  • CCTV monitoring operates throughout common areas
  • Professional security may be required for large events
  • Emergency procedures and exits clearly marked
  • First aid trained staff available during events
  • Incident reporting procedures in place

10. INTELLECTUAL PROPERTY

10.1 Photography and Videography

  • Averde Estate may photograph/film events for marketing purposes
  • Clients will be notified of any commercial photography
  • Clients may restrict photography in booking agreement
  • Copyright of professional photos remains with contracted photographers
  • Social media posting guidelines available upon request

10.2 Website and Content

  • All website content, images, and materials are copyrighted
  • Reproduction without permission strictly prohibited
  • Client testimonials may be used for marketing with permission
  • Virtual tour and property images remain our intellectual property

11. DATA PROTECTION AND PRIVACY

  • Personal information handled according to our Privacy Policy
  • GDPR compliance for all EU residents
  • Client data may be shared with necessary service providers
  • Marketing communications require opt-in consent
  • Data retention periods specified in Privacy Policy
  • Data portability and deletion requests honored

12. EXTERNAL VENDORS AND SUPPLIERS

12.1 Approved Vendor Lists

  • External vendors require prior approval
  • Vendor setup and breakdown times must be coordinated
  • All vendor contracts remain between client and vendor
  • We are not liable for vendor performance or services

12.2 Vendor Requirements

  • Compliance with Cyprus health and safety regulations
  • Written contracts recommended for all vendor services
  • Payment disputes between client and vendors excluded from our responsibility

13. SPECIAL DIETARY AND ACCESSIBILITY REQUIREMENTS

13.1 Dietary Accommodations

Menu modifications for dietary restrictions are the responsibility of the catering company providing the service. We do not accept responsibility for the preparation or handling of food. Clients must liaise directly with the catering provider to ensure their dietary needs are met.

13.2 Accessibility

  • Wheelchair accessible areas identified in venue layout
  • Accessible accommodation rooms available upon request
  • Special assistance arrangements must be made in advance
  • Service animals welcomed with advance notification and approval

14. CHILDREN AND MINORS

  • Children welcome at family events with adult supervision
  • Swimming pool areas require adult supervision at all times
  • Parents/guardians responsible for children's safety and conduct
  • Babysitting services can be arranged with advance notification

15. COMPLAINTS AND DISPUTE RESOLUTION

15.1 Complaint Procedure

  • Complaints should be reported immediately during your stay/event
  • Written complaints considered within 14 days of departure
  • Our management team will investigate and respond within 10 business days
  • Escalation procedures available for unresolved issues

15.2 Dispute Resolution

  • Good faith negotiation preferred for dispute resolution
  • Mediation through Cyprus Tourism Organization if required
  • Cyprus courts have exclusive jurisdiction over legal disputes
  • Cyprus law governs all contractual relationships
  • Legal action must be commenced within 12 months

16. MARKETING AND COMMUNICATIONS

16.1 Marketing Consent

  • Newsletter and promotional communications require opt-in consent
  • Marketing materials may feature property images and testimonials
  • Social media engagement and sharing encouraged
  • Client privacy respected in all marketing activities
  • Unsubscribe options provided in all communications

16.2 Reviews and Testimonials

  • Honest reviews appreciated on travel and wedding platforms
  • Written testimonials may be used for marketing with permission
  • Response to negative reviews handled professionally and promptly
  • Review authenticity important for industry reputation

17. SUSTAINABILITY AND ENVIRONMENTAL RESPONSIBILITY

  • Energy-efficient systems throughout property
  • Renewable energy throughout the property

18. GOVERNING LAW AND JURISDICTION

  • These Terms governed by the laws of the Republic of Cyprus
  • Cyprus courts have exclusive jurisdiction over disputes
  • European Union consumer protection laws applicable where relevant
  • Local Cyprus regulations supersede conflicting provisions
  • Professional legal advice recommended for complex bookings

19. AMENDMENTS AND UPDATES

  • Terms may be updated to reflect changes in law or operations
  • Significant changes communicated to confirmed bookings
  • Current Terms available on website and provided with bookings
  • Booking-specific terms in contracts take precedence
  • Legal compliance reviews conducted annually

20. SEVERABILITY

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. ENTIRE AGREEMENT

These Terms, together with your booking contract and our Privacy Policy, constitute the entire agreement between you and Averde Estate.
